Terms of Service

1. Acceptance of Terms

By accessing or using Ready Set Compliant ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

2. Service Description

Ready Set Compliant is a cloud-based platform that provides:

• Staff compliance document management and storage
• Automated expiry tracking and renewal reminders
• Staff onboarding workflow tools
• Compliance reporting and analytics
• NDIS audit preparation assistance

The Service is designed to assist NDIS providers in managing staff compliance documentation but does not constitute legal or compliance advice.

3. Account Registration

To use the Service, you must:

• Create an account with accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorised access
• Be at least 18 years of age

You are responsible for all activities that occur under your account.

4. User Responsibilities

As a user of the Service, you agree to:

• Use the Service only for lawful purposes
• Maintain the accuracy of information you upload
• Obtain appropriate consent before uploading staff personal information
• Comply with all applicable laws including the Privacy Act 1988 (Cth)
• Not attempt to interfere with or disrupt the Service
• Not share account access with unauthorised users
• Not upload malicious content or engage in harmful activities

5. Data Ownership

You retain all ownership rights to the data you upload to the Service ("Your Data"). By using the Service, you grant us a limited licence to store, process, and display Your Data solely to provide the Service to you.

We will not access, use, or share Your Data except as necessary to provide the Service, comply with legal obligations, or with your explicit consent.

6. Payment Terms

6.1 Subscription Fees

• Subscription fees are billed monthly or annually in advance
• All fees are in Australian Dollars (AUD) and include GST where applicable
• Prices may change with 30 days' notice

6.2 Free Trial

• New accounts may be eligible for a free trial period
• No payment is required during the trial period
• At trial end, you may subscribe or your account will be suspended

6.3 Refunds

Refund requests are handled on a case-by-case basis. Please contact hello@readysetcompliant.com for assistance.

7. Service Availability

We aim to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access and may occasionally need to perform maintenance or updates.

We will endeavour to provide advance notice of planned maintenance that may affect service availability.

8. Intellectual Property

The Service, including its design, features, and functionality, is owned by Ready Set Compliant and is protected by Australian and international intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the fees you paid in the 12 months preceding the claim
• We are not responsible for compliance failures resulting from user error or incomplete data entry

Nothing in these Terms excludes or limits any consumer guarantees that cannot be excluded under Australian Consumer Law.

10. Indemnification

You agree to indemnify and hold harmless Ready Set Compliant and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

11.1 By You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

11.2 By Us

We may suspend or terminate your account if you violate these Terms, fail to pay fees when due, or if required by law.

11.3 Effect of Termination

Upon termination, you may request an export of Your Data within 30 days. After this period, Your Data will be permanently deleted.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the Service will be governed by the laws of New South Wales, Australia. We encourage you to contact us first to resolve any issues informally before pursuing formal dispute resolution.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
